The ODSPDSP Regulation has sections.
Trust payments derived from an estate or life insurance policy proceeds and gifts or other voluntary payments may be exempt from treatment as assets and income if they are applied to expenses for approved disability-related items or services. Payments made pursuant to a court order or a government-funded program that are applied toward expenses for approved disability-related items and services are also exempt.
When assets are accumulated to purchase an approved disability-related item or service, the Director can approve an increase in the asset limit if the amount needed for the items and services is greater than the asset limit.
The items and services that are approved are not limited to: assistive devices, supporting services, health care and safety maintenance, renovations, education and training, and services.
Proper treatment of assets and income is required when purchasing approved disability-related items and services.
Scenario 1
A beneficiary of ODSP is receiving monthly support payments from their former spouse. Basic support is 500 and disability expenses are 200. 200 per month is used to pay for a day program for the recipient. In this scenario, support payments of 200 would be exempt from income because they are specifically designated and applied to approved disability-related items and services.
Scenario no.
An ODSP beneficiary is receiving monthly support payments from their former spouse. Basic needs such as food, clothing, and housing costs are covered by the amount that is paid for the cost of maintenance.
There is no mandated amount for expenses related to disability. The beneficiary uses 200 a month to pay for her day program. In this scenario, the person's basic needs and housing are covered throught, and so spousal support payments are not exempt as income.
Scenario #3 is no.
$500 a month is provided to an ODSP recipient to help with interpretation services so they can attend a training program.
The payments are exempt from income because they are for a service for people with disabilities.
The limit of prescribed assets should be increased.

However, any funds withdrawn from these trusts or insurance policies are considered income for the month received, unless used to purchase disability-related items and services that are approved by the Director, used to purchase a principal residence , an exempt vehicle or applied to the first and last month's rent necessary to secure the accommodation. 10,000 per benefit unit member can be withdrawn from funds held in trust or from the cash surrender value of a life insurance policy for any reason.

If used to purchase disability-related items or services approved by the Director, bank loans and loans from other sources are not considered income. If the item can't be purchased in the month the loan is taken out, they may be exempt as assets in the following month.
