There are a number of questions about the changes to the Barbering and Cosmetology licensing program, and the online guide developed by the TDLR may be helpful in explaining how the changes will affect specific types of licensees. The guide contains information about the law that was passed in the legislative session in 2021, as well as a link for those wishing to submit comments on the proposed rules.
September 27, 2022.
The Texas Department of Licensing and Regulation proposes amendments to existing rules at 16 Texas Administrative Code (TAC), Chapter 82, §§82.10, 82.20, 82.80, and 82.120; and the proposed repeal of existing rules at §§82.21-82.23, 82.26, 82.28, 82.29, 82.31, 82.40, 82.50-82.52, 82.54, 82.65, 82.70-82.74, 82.77, 82.78, 82.90, AND 82.100-82 and Cosmetology program. The proposed rules implement House Bill 1560, which consolidates the barbering and cosmetology professions into a single Barbering and Cosmetology program, with new license types and standardized requirements for practitioners, establishments and schools.
A summary of the changes can be found online.
The Texas Register published the proposed rules in September of 2022. Comments on the proposal will be accepted until October 24, 2022.
The Department encourages anyone interested in the program to review the rule proposal online. Comments can be submitted electronically on the Department's website.

The Texas Department of Licensing and Regulation enacted temporary distance education provisions in response to the COVID-19 PAIN.
Many schools could not offer in-person classes under state or local COVID-19 restrictions, so they were allowed to offer distance education.
The temporary provisions allowing licensed schools to offer distance education will end in November of 2022.
The rules for approval to offer distance education need to be followed by the barber and Cosmetology schools.

The instructor exam for barbering or cosmetology students must be passed by August 31, 2022, if they want to stay in the course.
The barber and cosmetology instructor exams will no longer be offered by the Texas Department of Licensing and Regulation on September 1, 2022, as a result of House Bill 1560.
Instructors in Texas are no longer required to have a license to teach courses in barbers or beauty schools.
Instructors of courses at a licensed barber or school in Texas need to have a barbering or cosmetology license in the specialty area they are teaching. Individuals with a Class A Barber license can teach all methods of barbering.

When you attempt to renew your instructor license, you will be issued a comparable license that allows you to continue to provide services and instruction within the scope of your license.

House Bill 1560 was signed into law by Governor Greg Abbott on June 15, 2021. The bill states that barber technician, barber technician/manicurist, and barber technician/hair weaver specialty licenses will transition to new license types by September 1, 2023. The barber technicians will be able to hold esthetician licenses, the barber technicians will be able to hold hair weaving specialist licenses, and the barber technicians will be able to hold manicures.
At a later date, the TDLR will provide advance notice for the transition of technician licenses to new license types. Until this transition occurs, technicians who are eligible for renewal should keep renewing their licenses.
Schools are required to keep reporting hours for students in barber technician, barber technician/manicurist, and barber technician/hair weaver specialty courses until further notice. If a student doesn't want to finish the course, they should submit a proper withdrawal request. The laws and rules of the school must be considered when giving refunds.
Schools may no longer enroll students in the barber technician, barber technician/manicurist or barber technician/hair weaver courses. Student permit applications can be submitted by mail. If students pass the technician exams, they will be able to take the exams, and if they pass the exams, they will still be able to get a technician license.

The 87th Texas Legislative Session ended on June 15, 2021. The barber and instructor licenses will be eliminated on September 1, 2023. The date for instructors to switch to new license types will be provided by the TDLR. Instructors who are eligible for renewal should keep renewing their licenses.

Instructors are no longer required to have licenses to teach courses in Texas barber or cosmetology schools.
Instructors of courses at a licensed barber or school in Texas need to have a barbering or cosmetology license in the specialty area they are teaching. Individuals with a Class A Barber license can teach all methods of barbering.
The completion of an instructor course will no longer be recognized by the TDLR. Students who were in an instructor course before September 1, 2021, can decide if they want to complete the course.
Schools can't give credit for completing professional development teacher training programs for teachers who teach barber or cosmetology courses, and the TDLR won't give credit for completing these courses.

Schools can determine what other qualifications are required for teachers to teach at their school. The professional development teacher training program offered by licensed barber or cosmetology schools will not be given any credit by the Tdril.
